Microsoft Puts Its Mad Face On, Sues U.K. Vendor for Selling Counterfeit CDs

Microsoft doesn’t take kindly to software vendors selling counterfeit copies of Windows and other Microsoft software and will sail the seven seas to chase down pirates when need be. Most recently Microsoft went in pursuit of a Comet, the name of a U.K. retailer the software giant alleges sold more than 94,000 counterfeit copies of its Windows Vista and Windows XP operating systems on pre-loaded PCs and laptops.

“As detailed in the complaint filed today, Comet produced and sold thousands of counterfeit Windows CDs to unsuspecting customers in the United Kingdom,” said David Finn, associate general counsel, Worldwide Anti-Piracy and Anti-Counterfeiting at Microsoft. “Comet?s actions were unfair to customers. We expect better from retailers of Microsoft products ? and our customers deserve better, too.”

According to the lawsuit, Comet printed the counterfeit copies in a factory in Hampshire and then sold the media to customers from its retail locations across the U.K. Comet, which is part of Kesa Electricals, issued a statement of its own defending its position.

“We note that proceedings have been issued by Microsoft Corporation against Comet relating to the creation of recovery discs by Comet on behalf of its customers. Comet has sought and received legal advice from leading counsel to support its view that the production of recovery discs did not infringe Microsoft?s intellectual property,” Comet said. “Comet firmly believes that it acted in the very best interests of its customers. It believes its customers had been adversely affected by the decision to stop supplying recovery discs with each new Microsoft Operating System based computer. Accordingly Comet is satisfied that it has a good defense to the claim and will defend its position vigorously.”

It’s not entirely clear, but it appears Comet is fessing up to creating recovery Windows discs for its customers. If that’s the case, the company probably doesn’t have much of a legal leg to stand on.

Windows 8 Explorer to feature Ribbon UI, SkyDrive and Mesh integration?

Rafael Rivera and Paul Thurrott have posted a second look at some of the early changes which have surface in Windows 8 milestone 3. First there was the restyled Welcome Screen, and now it appears that Microsoft is toying with bringing the Ribbon UI to Explorer.

The Ribbon, like in Microsoft Word and Excel, is context-aware, adding tabs for specific tasks which apply to the folder you’re viewing — such as library or picture management. You can also make out two new buttons in the status bar, which allow you to change the current folder’s view style.

It’s clear from all the placeholder images and repeated elements that this is very much a work in progress, but featuring the Ribbon more prominently in Windows 8 would certainly be a logical progression for Microsoft. It’s slowly become more ubiquitous, moving beyond Office and into Wordpad, Paint, and several of the Windows Live Essentials applications.

There’s more to the screenshots than the Ribbon UI, however. Our friend Long Zheng has noted two interesting elements in the images: Web sharing and sync (image after the break). That would likely mean users will be able to quickly upload files to SkyDrive and synchronize using Live Mesh right from Explorer in Windows 8. That’s not a total surprise considering many of the earliest leaked images of Windows 8 showed Windows Live integration on the desktop.

VMware adds Mozy to its cloud and virtualization empire

Mozy is one of the most popular cloud backup services around, with more than one million users storing around 70 petabytes of data. Its popularity apparently put it on the acquisition radar of VMware — which has now made Mozy part of its virtualization empire.

VMware’s official blog post makes it clear that the company wasn’t so much interested in Mozy as a consumer offering. Rather, it’s the inner workings of Mozy which piqued VMware’s curiosity. CTO Steve Herrod says, “Over the past 5 years, Mozy has built one of the best examples of a globally distributed, large-scale cloud offering.” He adds that the move will allow VMware to “further ramp our own cloud-related learning and accelerate new IP, scale, and capabilities” of its existing offerings.

Existing Mozy customers don’t need to worry, of course. VMware has pledged to continue running Mozy’s service without interruption.

Remember that first shot across Apple’s bow that HTC fired way back May of 2010? No? We don’t blame you. Since that initial exchange of complaints against each other the patent war has spun almost completely out of control. Well, in October an ITC judge handed down an initial ruling, rejecting the Taiwanese manufacturer’s claim that Cupertino and crew had infringed upon its patents. Now, almost four months later, a final judgment has been issued, consistent with the initial decision — Apple is not in violation of the patents in question (which primarily concern the dialer and power management features) and the investigation has officially been closed. Don’t get your hopes up too much though, this is just the first complaint in a long series of suits the two have filed against each other and HTC can always appeal in a federal circuit court. In other words, there’s plenty more where this came from.

BlackBerry Messenger 6.0 screenshots leak

A leaked early version of RIM’s upcoming BlackBerry Messenger 6 has been making the rounds since late February, but images of the new app are just now beginning to appear. Over at CrackBerry, the crew has shared a handful of images of BBM 6 in action. Unfortunately, you won’t get a glimpse at a chat or file transfer — only the profile screens (after the break) and what you see above. All that’s really revealed so far is the option to set custom contact and chat colors and BlackBerry OS 6.1-style icons.

CrackBerry also warns against installing the leaked BBM 6 app. There’s no guarantee this app hasn’t been tampered with, and BlackBerry devices are becoming a more common target for cybercriminals.

Publicly, at least, AT&T is bursting at the seams as it runs out of space to put all of its customers. The failed $39 billion purchase of T-Mobile was all about trying to match (or better) Verizon’s reserves of wireless spectrum. Given the FCC’s blocking of LightSquared and stymieing of future spectrum auctions for the time being, AT&T needs to make some more acquisitions — the $1.9 billion purchase of Qualcomm’s small slice of the airwaves isn’t enough. If the Wall Street Journal is to be believed, there’s a whiteboard in Whitacre Tower with Dish, Leap and MetroPCS written all over it. Reportedly, a purchase of Leap is the nearest to fruition, with “under the table” talks already underway. However, the Cricket Wireless operator would only provide a short-term solution to Ma Bell’s very long-term woes. The other big target is Dish Network’s reserved spectrum, kept back for its own planned broadband network, but if it fails to get Government approval, it might look to offload it. Third on the roster and marked as “highly unlikely” is a purchase of MetroPCS. The carrier was bitterly opposed to the T-Mo merger and pouted at the idea of purchasing some of Big Blue’s divested assets, so if those two met around a table, they’d have a lot of awkward apologizing to do.
